These Terms of Service ("Terms") govern your access to and use of our website (carinotree.com), your requests for quotes, and the contracted tree care, lawn maintenance, landscaping, and irrigation services we provide across Sarasota, Bradenton, and surrounding Florida counties.
By requesting an estimate, booking our crew, or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Scope of Services
Cariño provides professional outdoor property maintenance and tree services, including but not limited to:
- Tree Services: Hazardous tree removal, crane and bucket takedowns, precision tree trimming, crown thinning/raising, palm pruning, deadwood removal, and stump grinding.
- Landscape Design & Installation: Custom landscape plans, Florida-Friendly plantings, sod installation/replacement, bed edging, mulch, and decorative rock.
- Irrigation & Sprinklers: Sprinkler head repair, line fix, zone audits, valve replacement, backflow testing, and smart timer setup.
- Lawn Care & Maintenance: Scheduled mowing, edging, trimming, weed control, turf fertilization, and seasonal cleanups.
2. Estimates, Written Quotes & Work Orders
All estimates provided through our website, over the phone, or in person are free and non-obligatory. Written quotes are valid for 30 calendar days from issuance, unless otherwise noted.
- Clear Scope: Every project scope, pricing, haul-off details, and cleanup requirements will be stated in your written proposal before work begins.
- Unforeseen Site Conditions: In rare cases where concealed obstacles (such as buried concrete, hidden metal, underground bee/wasp nests, or internal tree rot) are discovered during operation, our team will stop and notify the property owner before incurring any additional fees.
3. Property Access, Safety & Underground Utilities
To ensure safe and efficient execution of your project:
- Property Access: The client authorizes Cariño's crew, trucks, and specialized equipment (e.g., chippers, stump grinders, lifts) access to the designated work areas on the scheduled service date.
- Underground Utilities (Florida 811): For deep excavations or stump grinding, Cariño coordinates with Sunshine State One Call of Florida (811) for public utility markings. Private underground lines (such as private lighting, invisible dog fences, or custom irrigation lines not installed by Cariño) must be identified or pointed out by the homeowner prior to work.
- Pets and Gates: For the safety of your pets and our crew, all pets must be secured indoors, and access gates unlocked prior to our arrival.
4. Licensing, Insurance & Standards
Cariño is a fully registered Florida entity and maintains comprehensive commercial general liability ($2,000,000 policy) and workers' compensation coverage on all active crews and vehicles. All tree trimming operations comply with industry-standard ANSI A300 pruning guidelines. Proof of insurance and certificates can be provided upon request for residential and commercial property managers.
5. Payment Terms & Invoicing
Unless a customized commercial contract or milestone schedule has been agreed in writing, payment is due in full upon satisfactory completion of the agreed work.
- Accepted Methods: Cash, check, and major credit cards / electronic payments.
- Commercial Accounts: Net 15 or Net 30 terms may be extended to approved HOA, commercial, and municipal clients with pre-authorized service agreements.
6. Scheduling, Cancellations & Severe Weather
Florida weather can be unpredictable. While we strive to meet exact appointment windows, safety is our utmost priority:
- Weather Delays: In cases of severe thunderstorms, lightning within the immediate area, high winds, or tropical weather warnings, tree climbing and aerial operations may be postponed to protect our crew and your property. Rescheduling will occur at the earliest safe window.
- Client Cancellations: Clients may cancel or reschedule routine tree care or lawn appointments with at least 24 hours' prior notice without penalty.
7. Communications & SMS Terms (A2P 10DLC Compliance)
By providing your mobile telephone number on our website forms or via direct inquiry, you consent to receive informational text messages (SMS) from Cariño Complete Lawn & Tree Services regarding your estimate, appointment scheduling, arrival updates, and invoices.
- No Third-Party Sharing: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
- Opting Out: You can cancel SMS messages at any time by replying STOP. Reply HELP for assistance.
- Carrier Rates: Message and data rates may apply depending on your cellular service provider.
8. Limitation of Liability
Cariño Complete Lawn & Tree Services exercises the highest standard of care on every property. To the fullest extent permitted by Florida law, Cariño shall not be liable for indirect, incidental, or consequential damages resulting from pre-existing structural decay of trees, severe storm damage Acts of God, or undisclosed private underground hazards.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Florida. Any legal dispute or proceeding arising under or in connection with these Terms shall be brought exclusively in the courts of Manatee County or Sarasota County, Florida.
